Terms of service

Welcome to UpperEast Jewels. These terms apply to your use of this website and to every order you place on it: by placing an order, you accept them. This English version is for customers in the United Kingdom and Australia. Please read them carefully. You can save or print this page.

1. Who we are

The website uppereastjewels.com is run by [COMPANY NAME] (“UpperEast Jewels”, “we”, “us”), a company registered in [COUNTRY/STATE OF REGISTRATION] with company registration number [COMPANY REGISTRATION NUMBER] and VAT number [VAT NUMBER], whose registered address is [REGISTERED ADDRESS]. Email: info@uppereastjewels.com. Phone: [PHONE NUMBER]. These terms apply to everyone who uses the website, including visitors and customers.

2. Products and availability

Our jewellery is 18K gold plated or silver-tone stainless steel. It isn’t solid gold or sterling silver. We do our best to show the colours and features of our products as accurately as possible, but we can’t guarantee that your screen shows the colours exactly. All products are subject to availability, and we may limit quantities or stop selling any item.

3. Prices and payment

If you shop from the UK, prices are in pounds sterling (GBP); if you shop from Australia, in Australian dollars (AUD).
Taxes in the UK: [UK VAT AND IMPORT CHARGES]
Taxes in Australia: [AU GST AND IMPORT CHARGES]
Delivery costs ([UK delivery cost] in the UK, [AU delivery cost] in Australia) are set out in our Shipping policy and added at checkout, before you pay. The price that applies is the one shown when you place your order: later price changes don’t affect orders you’ve already placed. We may change our prices at any time for future orders.

You can pay with the methods shown at checkout for your country, for example Visa, Mastercard, American Express, PayPal or Apple Pay. Payment is made through secure, encrypted channels.

4. How to place an order

  1. Choose your jewellery and, if there’s a choice, the option you want (for example the size or the letter), then add it to your bag.
  2. In your bag, check the products and quantities, then go to checkout.
  3. Enter your email address and delivery address.
  4. Choose how to pay and confirm with the final payment button. Before you press it, you see a summary of your order with the total price.

Correcting mistakes: until you press the final payment button, you can check and change all your details by going back to your bag or to the previous steps.
Language: you can enter into the contract in English (our shop is also available in Italian and Spanish).
Records: we keep an electronic record of your order and email you a copy. If you need it again, just ask.

5. Order confirmation and contract

After you pay, we email you to confirm that we’ve received your order. Our acceptance of your order, and so the contract between us, takes effect when we dispatch your order, which we also confirm by email. We may refuse or cancel an order if there’s an obvious pricing error, if we suspect fraud or if a product isn’t available. If that happens, we’ll tell you straight away and refund everything you paid without delay.

6. Delivery

We deliver to the United Kingdom and Australia.
UK: [UK: X–Y working days], [UK delivery cost]
Australia: [AU: X–Y working days], [AU delivery cost]
Personalised pieces need 5–7 extra working days to make. Your order is our responsibility until it’s delivered to you. All the details are in our Shipping policy, which forms part of these terms.

7. Cancellation and returns

You have 30 days from delivery to tell us you want to return your jewellery under our returns policy. You can try it on as you would in a shop: if it’s been worn beyond that, we may deduct the loss in value from your refund. If you can, send it back in its original packaging. Earrings can only be returned if still sealed, unless they’re faulty, and personalised pieces can’t be returned for a change of mind (if they’re faulty, your rights always apply). If you live in the UK, you also have a legal right to cancel within 14 days of delivery without giving a reason, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. The steps, the model cancellation form and refund times are in our Returns and refunds policy, which forms part of these terms.

8. Faulty pieces and guarantees

All our jewellery is covered by your legal rights as a consumer: in the UK, under the Consumer Rights Act 2015; in Australia, under the consumer guarantees of the Australian Consumer Law, which can’t be excluded. On top of that, our lifetime anti-tarnish guarantee lets you choose a new piece, store credit +10% or a refund if the plating tarnishes, flakes or peels with normal wear. It doesn’t affect your legal rights. The full terms are on our Guarantee page.

9. Intellectual property

All the content on this website (text, images, logos, graphics and the “UpperEast Jewels” brand) belongs to us or is used under licence, and is protected by copyright and other intellectual property laws. You may not copy it without our written permission.

10. Our responsibility to you

We’re responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We’re not responsible for loss or damage that isn’t foreseeable. Loss or damage is foreseeable if it’s obvious that it will happen, or if we both knew it might happen when you placed your order. If you live in the UK: we sell our jewellery for private use only, so if you use it for business purposes, we aren’t responsible for any loss of profit or business. If you live in Australia, this doesn’t limit your rights under the Australian Consumer Law.

Nothing in these terms limits or excludes our liability where the law doesn’t allow it, including for death or personal injury caused by our negligence, for fraud, or for your legal rights in relation to the products (in the UK, under the Consumer Rights Act 2015; in Australia, under the Australian Consumer Law).

11. Law, courts and complaints

These terms are governed by Italian law. If you’re a consumer living in the UK or Australia, this choice doesn’t take away the protection given to you by the mandatory consumer laws of the country where you live. You can bring a claim in the courts where you live: in the UK, the courts of England and Wales, Scotland or Northern Ireland, depending on where you live; in Australia, the courts or tribunals of your state or territory.

If you have a complaint, email info@uppereastjewels.com: we reply within one working day and do our best to sort things out quickly. If we can’t resolve it, we’ll tell you in writing the name and website of an alternative dispute resolution (ADR) body that could deal with it, and whether we agree to use it. In the UK, you can also get free advice from Citizens Advice (England and Wales), Advice Direct Scotland or Consumerline (Northern Ireland); in Australia, from the fair trading or consumer affairs office in your state or territory.

12. Changes to these terms

We may update these terms, for example because of changes in the law, technical changes or changes to our services. Each order is governed by the terms in force when you place it: later changes don’t affect orders you’ve already placed. The current version is always the one published on this page, with its date.
